PERAN PPNS (PENYIDIK PEGAWAI NEGERI SIPIL) DALAM PENEGAKAN PERDA SEBAGAI PENYIDIK DALAM TINDAK PIDANA TERTENTU DENGAN PERATURAN PERUNDANG – UNDANGAN YANG MENJADI DASAR HUKUMNYA

Abstract

Civil Servant Investigators (PPNS) are investigators from civil servants to investigate certain criminal acts. In order to improve law enforcement against violations of regional regulations, this PPNS was formed which is devoted to enforcing the applicable PERDA. This study aims to analyze how the role of PPNS in Enforcement of Regional Regulations as Investigators in Certain Crimes with Legislation which is the Legal Basis. This research uses a descriptive-analytical approach using an empirical juridical approach. The data is in the form of primary and secondary legal material collection carried out through library research and field studies where data is collected and then analyzed using descriptive analysis methods. In addition, this study also analyzes legislation and other documents related to the problem under study. The results show that Civil Servant Investigators have special authority in accordance with the laws and regulations that form the basis of the investigation law and in carrying out their duties are under the coordination and supervision of the National Police investigators. Special authority is an authority that is exercised based on the provisions of laws and regulations which determine the authority to implement the special regulations. In addition, Regional Civil Servant Investigators act as investigators in enforcing Regional Regulations as investigators in certain criminal acts with laws and regulations which are the legal basis. In its implementation, PPNS must be equipped with a warrant in carrying out its role as an investigator signed by the supervisor of the Regional Civil Servant Investigator in carrying out his investigative duties. In addition, Regional Civil Servant Investigators also have the task of providing guidance which includes general, technical, and operational guidance.
