PROBLEMATIKA PENERAPAN HUKUM ISLAM DALAM PENETAPAN HUKUMAN MATI BAGI KORUPTOR

Abstract


All nations in this world certainly want their people to always obey the law and government, as well as our nation, Indonesia is known for its people who always uphold the unity and integrity of the Republic of Indonesia. Realizing a just, prosperous and prosperous Indonesian society in accordance with the sound of the Pancasila and also the 1945 Constitution, where this noble goal is listed in Chapter XIV on the national economy and social welfare. However, all these noble and lofty ideals are often hindered by a possibly very chronic nation disease called corruption. Various actions as well as prevention to always eradicate corruption and irregularities related to corruption have long been promoted and also socialized by the government. Besides tormenting the people, corruption will also create a very bad image for a country. The various punishments and actions that have been implemented in this country to suppress the level of corruption which is getting bigger every year, the nature of the punishment that is considered light has not yet indicated the principle of justice which is always contrary to the values of Pancasila and also existing laws. The state of Indonesia is also known as the largest Islamic religion in the world, where the participation of Muslims is also very much demanded in overcoming the problems of corruption that exist in this country. The purpose of this study is to formulate a definition of corruption in Indonesia from the perspective of Islamic law and how to conceptualize corrupt practices in Indonesia from the perspective of Islamic law.
